Host-Racks Copyright and Intellectual Property Policy
Host-Racks.net respects the intellectual property of others, and we ask our users to do the same. All images and content displayed on the web-pages of the Host-Racks.net website are either owned by Host-Racks.net or properly licensed. If you think we are using content, the copyright to which is owned by you, a third party, or not properly licensed for use, please see the legal procedure below you should follow to bring it to our attention.
Host-Racks has no responsibility for content on other websites that you may find or access when using our website or services. Material available on or through other websites may be protected by international copyright and the intellectual property laws, those of the United States and/or other countries. The terms of use of those websites, and not the Host-Racks Terms of Service, govern your use of that material.
It is Host-Racks’ policy, in appropriate circumstances and at its sole discretion, to disable and/or terminate the accounts of users who may infringe the copyrights, or intellectual property rights of Host-Racks, or others.

If you think that your “copyrighted work” has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, please provide Host-Racks’ Agent for Notice with the following information.
Please note that you will be liable for damages, including all costs, court costs, and attorneys' fees, if you materially misrepresent that content or activity is infringing your copyrights. If you are not sure whether material published on Host-Racks.net infringes your copyright, or is “Fair Use”, we recommend that you contact an attorney prior to placing a claim.
To expedite our ability to process your request, please use the following format (including section numbers):
All information is required! We do not answer claims that do not contain the required information. No exceptions.
- Place the words "DMCA Complaint", in the subject line of your email.
- Identify, in specific detail sufficient to identify the subject of your claim, the copyrighted work that you believe has been infringed. For example, "The copyrighted work at issue is the text, “first few sentences of the actual text”, or image, that appears on http://www.Host-Racks.net/original_work.html".
- Identify the content, on Host-Racks.net, that you claim is infringing the copyrighted work listed in item #1 above. For example, “The following page infringes on my copyrighted work located at http://yourworksite.com/Infringed_content”.
- Provide the original date of copyright, the name of the copyright holder, a copy of the transfer of copyright if you are not the original copyright holder, and the Copyright Office Copyright Registration Number.
- If you provide a rights-management license service, scan into your claim email a copy of the rights-managed (RM) license agreement. Do not send an attachment. Attachments are removed and your claim will not be answered until the required information is provided within the body of a single email.
- Provide information reasonably sufficient to allow Host-Racks to contact you (email address is preferred). We do not respond by telephone.
- Include the following statement: "I have a good faith belief that use of the copyrighted materials described above as allegedly infringing is not authorized by the copyright owner, its agent, or the law."
- Include the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
- Provide an electronic signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest.
- Send the claim to the following address copyright_infringement @ Host-Racks.net .
Note: If you are asserting infringement of an intellectual property right other than copyright, please specify the intellectual property right at issue (for example, ‘trademark’).
In some circumstances, in order to notify the subscriber, account holder, individual, or host who provided the allegedly infringing content to Host-Racks, we may forward a copy of your Claim, including all the required information, to the subscriber, account holder, individual, or host.
We may also forward a copy of your Claim, with personally identifiable information removed, to Chilling Effects (http://www.chillingeffects.org) for publication.
In rare occasions when we receive multiple, false "extortion" claims, we will forward the entire claim, including all information, to the Attorney General of the State of Illinois.
Due to security concerns, please do not send an email with attachments. Any notification of infringement email sent with an attachment will not be received or processed.
